Get Planning and Architecture - Enforcement Appeals & Council Liaison

Enforcement Appeals & Council Liaison

If you are using a building without getting the correct planning consent, then you might well find yourself facing planning enforcement action. The same might apply if you have built an extension or an outbuilding or other development which does not have precisely the right approval. At Get Planning and Architecture we witness many situations where enforcement is in place or threatened, often due to the different interpretations that can be made about Permitted Development, (such as the size and height of loft additions or outbuildings).

An enforcement notice leaves property owners with the unpleasant and financially burdensome prospect of having to cease commercial use, modify or even demolish a development.

There are very often good grounds to appeal an enforcement notice and if the appeal succeeds fully then you will be able to keep your development. Information about the circumstances under which you can make an appeal, and the deadline for appealing can be found on the enforcement notice. If you are unsure about whether you have grounds for appeal, one of our professionals will be happy to advise you.

We would urge you to give careful consideration to any statements that you make to planning or enforcement officers and to contact us as soon as you become aware of any threat of enforcement. Please note that your Council is required to send you a formal Planning Contravention Notice, (PCN), before a legal Enforcement Notice, (EN), can be served on you. In very many cases, we have been able to postpone or completely avoid enforcement action by liaison and skilful negotiation with planning officers, thus saving our clients money and a lot of stress.

Enforcement appeals can be technically complex and the stakes are often high for clients, so it is important that you choose experienced professionals with an expert knowledge of planning and regulations. This can give you some peace of mind in a very stressful situation. Get Planning and Architecture, a Chartered Planning Practice, works to the high professional standards dictated by RTPI. We also have considerable experience in managing such appeals.

Council liaison

Whether an appeal to the Planning Inspectorate is required, or not, Get Planning and Architecture can, subject to your instructions, engage in dialogue with Councils and officers to reduce or avoid the impacts of enforcement on your property.
